You are responsible for ensuring that all communications sent through or initiated by the Services — including those made by Dale AI's automated systems on your behalf — comply with all applicable laws.
3.1 TCPA and Telemarketing Rules
- You must obtain and maintain records of prior express written consent before using the Services to place autodialed or AI-voice calls or send automated text messages to any person
- You must honor opt-out and do-not-call requests promptly, and no later than within the timeframes required by law
- You must maintain an internal do-not-call list and scrub against the National DNC Registry as required
- You must comply with calling-time restrictions (no calls before 8:00 a.m. or after 9:00 p.m. in the called party's time zone, or stricter state requirements)
- You are responsible for compliance with any state-specific telemarketing registration, bonding, or disclosure requirements
3.2 CAN-SPAM and Email

- Opt-out requests must be honored within 10 business days
3.3 Call Recording

- You must configure the Service's recording disclosure settings appropriately for your jurisdiction and provide any required disclosures or notifications before recording begins
- Dale AI does not provide legal advice regarding call recording compliance and makes no representation that any particular configuration satisfies the requirements of your jurisdiction
3.4 Consent Is Your Responsibility
Dale AI provides tools that initiate calls, send texts, and send emails on your behalf. The legal obligation to obtain, document, and retain valid consent rests with you, not with Dale AI. Dale AI does not verify that you have obtained the necessary consents.
4. Fair Housing Compliance
Real estate professionals using the Services must comply with the Fair Housing Act (42 U.S.C. § 3601 et seq.), state and local fair housing laws, and all related regulations. You may not use the Services to:

- Configure AI prompts, lead qualification criteria, or communication workflows in a manner that results in discriminatory treatment or disparate impact
- Generate or distribute advertising or communications that indicate a preference, limitation, or discrimination based on a protected class
You are responsible for ensuring that your use of AI-powered features — including automated lead scoring, call scripting, and follow-up prioritization — does not produce discriminatory outcomes.
5. Data Use and Privacy
- You must comply with all applicable data protection and privacy laws when collecting, storing, and processing personal information through the Services
- You may not use the Services to collect personal information from individuals without appropriate notice and, where required, consent
- You may not sell or share personal data obtained through the Services in violation of applicable privacy laws, including the California Consumer Privacy Act (CCPA) where applicable

- Issue a warning and require corrective action within a specified timeframe
- Suspend or restrict your access to the Services, in whole or in part
- Permanently terminate your account
- Remove or disable offending content
- Report violations to law enforcement or regulatory authorities as required or appropriate
Repeated or severe violations may result in immediate termination without prior warning. Suspension or termination for AUP violations does not relieve you of your payment obligations under your agreement with Dale AI.
